EULA - End User License Agreement

This license agreement (the "AGREEMENT") is an agreement between you (the "END USER") of CheckDrive (the "SOFTWARE") as individual or single entity and Horst Spierling (the "AUTHOR" ).

The SOFTWARE is the property of the AUTHOR and is protected by copyright laws and international copyright treaties. The SOFTWARE is licensed, not sold.

If you do not accept the terms and condition of this AGREEMENT, you must destroy all copies of the software and its supporting materials, including the documentation.

If you accept the terms and conditions of this AGREEMENT, you are granted the following rights:

You are allowed to:

- Install and use the SOFTWARE for an evaluation period of 45 days from installation date.
- Use one or more copies of the SOFTWARE for evaluation purposes only.
- Copy and freely distribute the SOFTWARE as described under "DISTRIBUTION".

You are NOT allowed to:

- duplicate or distribute license keys to unlock the SOFTWARE
- apply any license keys to the SOFTWARE not received directly from the AUTHOR
- Sublicense, rent, sell or lease the SOFTWARE or any portion of it.
- Decompile, disassemble, reverse engineer or modify the SOFTWARE or any part of it.

REGISTRATION

On registration you will receive a personal license key to unlock the SOFTWARE and to use the SOFTWARE beyond the 45 days evaluation period for an unlimited timeframe as long as you comply with all of the limitations described within this AGREEMENT.

The license key is valid for all versions within that major release e.g. from Version 2.00 up to Version 2.99.

DISTRIBUTION

You are allowed to make as many copies of the SOFTWARE as you like and distribute it to anyone provided that all files remain intact. You must distribute the original installation package of the SOFTWARE. You are not allowed to sell the SOFTWARE. A reasonable shipment and handling fee may be charged. Magazines are allowed to distribute the SOFTWARE on their Cover Disk or CD-ROM without any permission. Please send us an email to sales@spierlink.de each time you distribute this program, along with the magazine name and number.

WARRANTY DISCLAMER

THIS SOFTWARE IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND. TO THE
MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AUTHOR FURTHER
DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THIS USE OR PERFORMANCE OF THIS PRODUCT AND DOCUMENTATION REMAINS WITH THE END USER.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO CIRCUMSTANCES SHALL THE AUTHOR BE LIABLE FOR ANY CONSEQUENTIAL, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR OTHER DAMAGES OF ANY KIND (INCLUDING,

WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS INFORMATION, BUSINESS
INTERRUPTION, LOSS OF BUSINESS PROFITS, OR OTHER PECUNIARY LOSS)
ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF THE AUTHOR HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.
